Has your EAD renewal been pending more than 60 days? More than 75 days? Will you be left without work authorization? If so, don't fear. There is a solution available. The Nebraska Service Center has finally recognized that processing times for EAD and AP renewals have exceeded past processing times, often leaving applicants without valid work authorization. The NSC in conjunction with the American Immigration Lawyers Association has released a way to expedite the processing times. HA! Finally! someone noticed this! Well, i have already taken matters into my hands. I filed July 2 and my permit expires Sept. 5. Two years ago i NEVER had this problem, my biometrics arrived only a month after I filed my renewal online and after being fingerprinted for the nth time, i received my new work permit in just over 1 week! So what did i do? Naturally I called USCIS's 1-800 number and was able to talk with an agent who was very, very helpful. She suggested we file a request to expedite the processing of my EAD IF, i fall under a certain category. The number one reason she gave was the ONLY reason that will suit me very, very well and that is "delay of alien's work permit will result into SEVERE FINANCIAL LOSS TO EITHER THE COMPANY OR BUSINESS OR TO PERSON". Well of course it will be a severe financial loss to me! I have rent to pay, car payments to make, food to put on the table and support family back home! So she went and filed it and informed me that within 5 days i will receive a letter from USCIS that such a request has been made and to follow the instructions that will be written on the letter. So what did I do next? I told all my friends, classmates, the DON of my sponsor hospital what to tell all the sponsored RNs who are having this sort of delay to call USCIS asap and tell them about their desperate situation. My DON quickly told our HR to talk to me and soon I received calls from RNs from our sister hospital and told them to argue their case with USCIS. My classmate was able to get the same request to expedite and has thanked me profusely. Now the thing is, I HOPE, USCIS will deliver!
ReplyDeleteFunny thing is, another friend of mine mailed his application in May and his EAD expires in August and guess what, by June, he got his new EAD! So something is really really wrong somewhere? I am begining to think that USCIS laid off a lot of USCIS agents due in fact to the rapid decline of applications both for EB3 and H1B and so when the renewal of EAD applications started pouring in (remember in July of 2007 a record number of 300,000 applications were received!) naturally they are now understaffed and thus the cause of this delay. Of course this is just my guess but what else could it be? Renewals shouldn't take too long since these sponsored alien workers' data are already in their computer system. Especially those who filed online because this is real time unlike those who mailed their renewals.
Anyway, whatever it is I am glad this inconvenience is now being rectified because it screams of unfairness to us legal aliens who work so hard and pay correct taxes to Uncle Sam. RNs with expired permits are either suspended or terminated, as in the case of my coworker, and they can't renew their driver's license it's a total stoppage of income generation! Sleepless nights, stressful days of waitng for their new EAD, how can USCIS be so nonchalant about this you ask.
I really hope to get my new work permit before Sept 5. I am so glad someone is doing something about this!
My EAD expires on Aug 21st, and I am still waiting! I originally filed 120 days before on Apr 21st, but my application came back from the lockbox saying I did not submit the I-485 receipt. But I never received the I-485 receipt to begin with and even after numerous requests for duplicate receipts. My lawyers then e-filed on Jun 10th, and I got my biometrics for Aug 12th. Per my lawyers instructions, I went earlier and got my biometrics done 2 weeks back and they had expidited my case. The officer at the biometrics office even told me it only takes 24 hours to process the application after the biometrics is completed. But it has not happened so far, my application is still stuck at "initial review". I am sure going to be terminated on the 20th if my renewal does not come through! sigh!!

ReplyDeleteI had applied for renewal 117 days ago.. had my biometrics done in a month but still i had nothing till now..
Today my case status changed and said USCIS have mailed for 'request for evidence' Still havent got the letter, so dont know what they are asking for.
Its so unfair.. all this while 117 days they didnt send any request and now 1 day before my ead is about to expire they are asking for more documents.
i am loosing my job ;( :(
