INVENTORY OF NVC CASES:

The National Visa Center has issued a report of the number of visa applications in the employment-based categories and family-based categories pending at the NVC. What is most noteworthy for foreign nurses from the Philippines is that the NVC has 45,331 EB3 cases from the Philippines – that represents 43.8% of the 103,448 total EB3 cases at NVC. By comparison, India has 18.8% of the pending EB3 cases at NVC and China has 6.9% of the pending EB3 cases.

However, that is not too surprising considering the following:
(1) The vast majority of Filipino immigrants in the employment-based category are nurses (because they don’t typically qualify for a nonimmigrant visa their immigrant cases fall within the purview of NVC rather than I-485 adjustment of status cases). In contrast, the number of pending I-485 cases (those in the U.S. on a temporary status and adjusting to permanent residence) for India are more than 5 times (5x) higher than the Philippines.
(2) Retrogression for nurses has been in effect since October 2006 (with the exception of the two month reprieve in the summer of 2007 when dates were current; however, only a small percentage of nurses were able to get through that narrow window of opportunity to get the immigrant visa). Given the I-140 and NVC processing times in NVC, most of the cases took at least a year to process, therefore, most of the applicants that received permanent residence were applicants who had filed in 2005 or earlier. Overall, the number of pending EB3 cases for the Philippines is not bad when you consider it is an accumulation of almost five years of cases due to retrogression.
(3) USCIS has been processing I-140 cases more quickly in the last six months, thus some of the cases that appear on the NVC inventory chart are cases that were previously recorded in earlier charts for “Pending I-140’s” or “Approved I-140’s” from data the USCIS issued last year.

By law, the minimum number of employment based green cards allowed per year is 140,000. The “actual” number of employment based green cards that have been issued in the EB3 category (overall for all countries) during the last three years is as follows: 89,922 in 2006, 85,030 in 2007, and 48,903 in 2008. Note: the larger number in 2006 and 2007 is in part due to the Schedule A legislation that provided for an additional 50,000 immigrant visas.

There are two “positive” points to keep in mind:
1) According to the NVC report, the “total” number of Filipino cases in all the first three employment-based categories is 47,420. Thus, 45,331 of the total 47,420 Filipino cases are in the third preference category (only 2,089 in the 1st preference and 2nd preference category for the Philippines). That is important because the unused visa numbers for the Philippines in the first preference category and second preference category get to “trickle down” to the third preference category for the Philippines.
2) There are at least some cases that are duplicates, and thus fall out of the system. Some applicants have lost their sponsorship (company went out of business and/or job no longer available) and have obtained sponsorship through a second employer. Thus, some applicants have more than one case pending.

  1. Excuse me? Those who got their GC because they filed since 2005? I have to classmates both filed just before closing hours in Oct. 31, 2006 and THEY GOT THEIR IMMIGRANT VISAS June 2007!!! I got filed ahead of them in August 2006 and until now NO GC! I have not gone out of the US, diligently staying put, working, paying my dues to Uncle Sam and I'm still in limbo? It just goes to show that some people in USCIS really do their jobs and others just slack off! I am a victim of RED TAPE! You immigrant lawyers know this, some have very good aggressive lawyers that get their clients their GC ASAP and some lawyers just sit on their butts! Guess which one I got!

  4. hi can somebody answer my question? my visa screen will expire on dec. 20011. and case completed already. is it true that i dont have to renew my visa screen anymore or take the IELTS exam bec. my case is already at manila US emabssy waiting for interview( case completed) ? or do i have to take the
    IELTS to renew my visa screen?

    Thanks for the update. Any idea how many Indian RNs cases are pending with USCIS? Many of the RNs philippines may finally not qualify for the green card because some applications were filed as per previous law when I 140 petitions could be filed with copy of CGFNS score card. This will be the same with Indian RNs and some from the rest of the world. It is also true that some Nurses have reached USA through their new employer but USCIS may not have cancelled the previous I 140 petitions.

    If you reconcile with the total number of visa screen certificates issues by CGFNS and the RNs already reached USA, even 30,000 RNs may not be available to come to USA.

    IF A SPECIAL VISA LAW IS NOT PASSED LIKE THE PREVIOUS 50000 VISAS, EITHER PHILIPPINIS OR INDIANS WONT GO TO USA IN THE NEAR FUTURE

  10. about this NVC INVENTORY article ,what is the situation of the nurses coming from europe countries, what is the percentage of visas and how much visas are available for category EB3? and what is their situation in the NVC INVENTORY cases.

  11. Perhaps you didn't read the blog carefully. Given the I-140 and NVC processing times in NVC, most of the cases took at least a year to process, therefore, most of the applicants that received permanent residence were applicants who had filed in 2005 or earlier. It clearly says only a small percentage received their GC's during that time --- as your situation indicates, you are one of the many that did NOT. Those small percentage that received their green card were not the result of aggressive lawyers but rather the visa numbers. Let's stick to the facts. No doubt any lawyer and staffing company is likewise anxious to get the GC for the person as quickly as possible.

  17. I don’t understand why PD movement for the ROW applicants is so slow??
    Bcz during the retrogression all RNs suffered but the most who suffered are applicants from ALL CHARGEABILITY AREAS, since applicants from Filippine, India and China together make almost 70 % of total applications. While applicants from ROW makes less then 30 %. So What about the 7 % Per Country limit?, bcz if the PD for some countries move as the ROW, so there is no need to separate them.

  22. I don't really understand how they work things out in NVC. A friend of mine applied 2008 but went to US 2009.It doesn't matter which country u r coz bulletin is 12/02. Anyway, When will I receive pocket 3 after I-140 approved? My i-140 approved in less than 3 months. whats gonna happened next? Is this the start of the very long waiting period? thanks guys.keep the faith.

    Hello Gab, many still are here with PD of 2003 and 2004.I'm one of them, my PD is in the first quarter of 2004. I had some sort of problems with the processing of my papers that's why I'm still here waiting for my luck.

  30. to helen and brent. I think thats me sept09 PD. If it's 7 years then probably I'll stick my ass in here. I'm just fed up with the weather here. Agency tells me 18months max last 08. For about a year of research now about visa behavior, I don't think america's nearer now sooner than I thought. But it's something to look forward thu. so guyz, time will come for america to beg for us to come.hehehe, Good luck to all of us.

    STATISTICS SHOWS THAT PERSONS WHO ARE TAKING NCLEX-RN EXAM HAS REDUCED TO ALMOST HALF WHEN COMPARED TO PREVIOUS YEARS

    MANY USA ASPIRANTS HAS MIGRATED TO OTHER COUNTRIES DUE TO THIS LONG WAITING TIME

  35. it is very confusing why cgfns continue to accept cases when retrogression is so tied .why is it for money?.nurses are waiting for years without any reason and they promote to register with cgfns .they should respect people waiting and clear there cases before accepting new demands .why why ,no consideration for nurses waiting this is democrathy to make several wait and encourage new cases to filled.it is a lack of respect.you do not want foreign nurses fine say it clear and stop playing withnurses with no consideration like they are simply numbers in your ststistics foreign nurses deserve more respects as honest human beens.will president obama listen and work for CHNGE as he claim when he was campaigning.parole parole it change for the worst.

  36. Nothing is reliable here! The truth is, some got their visas earlier (EB2,EB3) than what is shown in visa bulletin.I also think that it`s up to the lawyer that handles the papers,it`s up to how much money you pay them to get their ass off their seats.It`s so sad coz it^s the way it is and there`s nothing we can do.If you are in your homeland 3rd world,try to switch to another opportunity like Australia and Canada,they are the next best on the line or if you`re still young and have money and patience,make further education or specialty.Only God can say when our turn will come.
