The future of Rn's who's trying to USA are just becoming a big question and a nightmare.Just getting bombarded here and there from Dec 2006.Was this time not sufficient to come into a decision??
So many of the RN's who's processing to USA is half way is now heading towards Canada,Ireland and UK.If this is the situation then there will be hardly any nurse to migrate to USA...After so many exams they are still no where and just with 1 exam IELTS they will be able to go to countries like Canada,Ireland ,UK an australia.......

My PD is July, 2005, was interviewed on 20 May, but was not issued visa bcz the Consular Officer give me a blue refusal Form asking to submit additional information about my Sponsoring Agency's Bussiness. I m CGFNS, NCLEX-RN Passer having Visa Screen Certificate, having RN License. Kindly give me your expert opinion. Will I be able to get visa in this FY. What if my PD retrogress in July VB? Or once I m interviewd my case do not depend on current/ retrogressed PD. Anybody with a situation like mine plz respond? Why the embassy asked such information, I know there is everthing OK with the Agency.

My two friends have consulate interview but did't get Visas.
Problem is Agency they have shutdown office and not so reliable but we all have contracted with them if we break to join other then he will sue us moreover I140 and NVC will take time

It was sad that we had to undergore several exams..CGFNS, IELTS, NCLEX, VISASCREEN etc with huge cost and long duration with a dead end. it looks more of a con game.
forget about congress issues and if your IELTS (that is all they require except canada which will give you ample time to do the exam as you work) is still current apply to progressive countries like canada, australia and new zealand.

Pushok- If the the consul is asking for additional evidence from your sponsor's, it means that there is something wrong. Have you check the name of your petitioner in your Approval notice from USCIS? Is it the same name in your contract and offer of employment? What about the hospital that you are going to work with? Are they still connected w/ your agency? How about a pending case?Best advice, is you ask your sponsor regarding this. If you dont have the visa yet and it retrogressed or your PD isnt current on the following month, they will not issue it. You have to wait for your PD to be current before they can resume processing your visas or releasing it.

Since you mentioned everything is OK with your petitioner Immediately arrange the required information to the consulate officer. A visa number is kept for you now for the month of June at your consulate. Do this immediately. Do not delay a second. If you delay to July, then you may raise up your eyes. Let GOd helps you, if the PD is retrogressed in July.
eoTrushaben- I would like to help you but I dont understand most of the things you are saying. If your agency has shut down then you are in BIG trouble. As iN BIG! What's the matter with your friends? Why are the visas not issued?

Maybe you should frist try to find out from your friends why they were refused visas. What do you mean by "Agency has shut down office" do you mean that they have shut down full operations? in that case you may have to start all over again with a new sponsor and new I-140 petition.

Thank you for your effort. Thank you very much. Now, I know very well that it is my choice to go to the United States and therefore it is my choice to go to nursing school and pay for it. Take nclex and pay for it. Take ielts and pay for it. Get visascreen and pay for it. But off course, there risk in every endeavor. As a nurse I certainly understand the dynamics of the politics of immigration in America. There are deep interests in play here. There is the ANA which is really against and using its influence to block any immigration of nurses from other countries of nurses of going to America not that they are incompetent(the foreign nurses) but they (ANA) would just love to produce nurses from America, and they think they are the only "best nurses". Its all right, it is always proven otherwise. There are the nursing schools, that would certainly salivate in the prospects of the monopoly of producing nurses just from them and they think that they have the monopoly of knowledge but off course they are looking at the profit that they would make. And most of all the lobby groups, including among others, the Hispanic caucuses, the democrats and take note, the hispanic caucuses are democrats themselves and most of all the republicans, who would really giggles to see the US congress fails in every step of the way specially with immigration, just because it is controlled by democrats. But I am really irritated by these bloggers who are for a lack of a better term, nincompoops who seemed to maligned your every effort, just because they are ignorant and their understanding for a lack of a better term again, an IQ of below sea level.
Please continue your effort because those of us who believed in your effort and understand how difficult it is, will just do our part and we will just prepare ourselves for that time that will come and our dreams and effort will come into fruition.

# NVC is predicting visa will retrogress in coming months ;but may only adjust it if their prediction for approaching near annual limit by CIS for AOS is inaccurate!!!
# people are hopeful that it will advance further !!.
# Lawyers are very sure that visa office didn't violate federal law in earlier months!!
# If we all are accurate, visa office still must have enough visas to issue in final quarter(far-more than they issued in first 3 quarter)
bcz around 25% from EB-1 ,5-10%EB-2,5% from EB4-5 and 19% of same group for final quarter makes large pool in final quarter to issue.So large chance to forward EB-3 philipine/ROW and a little bit for EB-2 india,china.

My sponsor is White Glove Placement Inc. in NY. Which is also the petitioner and my employer. My employment letter for consulate was from my agency since my interview was on very short notice, i.e, on 01 May I came to knew that I was scheduled for IV interview on 20 May. Due to this reason My agency was unable to get an Employment letter from the Hospital.
Valerie what u mean by PENDING CASE? My employer is till now co-operative and promised that they are working on the documents needed for the consulate.

My employer is also White Glove, the petition was filed 2 years ago and up to now it is still pending with the uscis. I have been asking them what could be the problem and they would not tell.
Good news? I have already moved to Aus for 10 weeks adaptation. It was expensive but no other way to protect my IELTS Score..
Pushok- Your agency just needs to get a letter from your future hospital stating that a position is still available for you. Ask White Glove for updates daily.
Egon- it depends on where Service Center they filed it. Check the Case Status service online for the date they are currently processing. The Service Center is currently so slow.

Congrats! You mean you moved to Australia to work as a nurse? If the answer is yes, what was the procedure and how long does it take to do that. I've read somewhere that they need the nurse to have an expereince before he/she can work in their country.

I am so disappointed with your case.... First of all you should not attend the interview without the letter from your agency. The letter must be like this....
With the Logo of the agency, address to the immigrant Visa Chief officer, Your agency must know whom to address the letter.
The letter stating that you were offered permanent employment as RN by your agency, that you are qualified as RN with experience of so in so..... Also they should state which hospital are you going to work in USA. basically that's all you need, must be signed by the Director of immigration and licensure of your agency and must be Notarized.
If you have this letter they will give you your VISA, please hurry before you it's tool late....
Don't forget to xerox at least 4 pcs. you will be needing that in USA.

In fact, very difficult to predict this time. bse USCIS has already predicted in June visa bulletin that annual limit for EB3 is reaching and it would be retrogressed further. But as per law, more visas can be available in the final quarter. NVC also now process cases upto December 08 indicating PD advance further.
Either USCIS is lying or they are smart in using EB3 in first 3 quarters.
Let us wait for another 10 days to unvail the drama. Bulletin can come by 13th
There is an update on www.immigrationvoice.org regarding the 3 Lofgren bills including HR 5882). It states that all 3 immigration bills have been scheduled for hearing in the House Judiciary Committee on 16th and 23rd. Although the official web-site for that committe has not been updated for those dates I guess IV is right about the info.

Why don't you contact any hospital directly? It is so easy, and by doing this you would avoid USCIS main question - ability to pay you prevailing wage

It will take a while, since your main petitioner is your agency you have to wait, basically your agency will show your files in each hospital and if the hospital agreed with the condition by the agency then be it, you might be lucky if you will not undergo Phone interview. You cannot apply directly to the hospital, because your petitioner is your agency, just don't give up, always have contact with your agency if possible everyday, By the way is your agency valid? I mean POEA accredited? check it out.

Is white glove agency main brach in NY? it seems they stated all kind of hospital but they did not mention which hospital....some agencies did. anyway why don't you call the main branch in USA NY? they will help you for sure. just try it.

im also under whiteglove care in NY. i applied through their online application in their website. our communication is through phone and email only. they did work on my petition and my PD is Mar 16, 2005 (still waiting). i don't have an Employment letter from the Hospital too. maybe i wil be asking them for that now. though i have known a somebody who is under whiteglove too and had her visa 2 years ago. she didn't have any problem with the interview.

I know a few people who signed up with WG, and they are all pending with the USCIS. I think at least my papers would reach the visa center so that when the retrogression is lifted I will be given visa. But up to now it is still pending. Very frustrating! Something must be wrong, by the way, WG is located in New York.

Hi, Ur PD is earlier than mine, why u r still waiting? I m from EB-3 ROW. Ur Employment letter shall be a part of ur Interwiew package, which u shall receive from the employer when u shall have an IV interview date.

Hi, Very strange that ur cases are pending. My case was processed in VT center. I think there is nothing wrong with our AGENCY. But better to confirm and reconfirm. I think if they r hireing so much nurses, everything should be OK with our Agency.

During phone interview they will ask you your employment history, which hospital you are currently working, what kinds of equipment you handled, if you are assigned in M/S ward or wherever, definitely will ask you the cases, and will give some scenario for that cases, if you are under stress because of lots of things to do how will you handle it? mostly that stuff. Depend on your experience. it will take 45 min. to 1 hour.
