HR 5924 Gaining Momentum

As you may be aware, all immigration provisions were stripped from this week's War Appropriations bill. There were several reasons that the immigration provisions were stripped, including germaneness, interest in adding some family immigration provisions, and Congress’ desire to quickly move on the Appropriations bill before Memorial Day. That bill may ultimately be vetoed by President Bush, in which case there may be a small chance of reattaching some immigration provisions to a reconstituted Appropriations bill.

HR 5924 is gaining a lot of steam. We’re up to five named co-sponsors and HLG knows of two more House members who will co-sponsor but it hasn’t been made public yet. The named co-sponsors are:

Rep McCarthy, Carolyn [NY-4] - 5/14/2008
Rep Putnam, Adam H. [FL-12] - 5/14/2008
Rep Cohen, Steve [TN-9] - 5/22/2008

This is very good progress considering that the bill has only been public for a month. Several other Representatives have said that they will support the bill, but they will not formally co-sponsor.

The most important thing that we can do at this point is to increase the number of co-sponsors. HLG and the CTIHS have been to Washington DC twice in the last two weeks to walk the halls of Congress and inform Congressional staffers about the issue. We are continuing to actively seek more members to the CTIHS in order to raise our profile. If you are interested, please contact Chris Musillo.

All the best, the more co-sponsors we get, the sooner bill will be taken up for mark up in the committees. By the way even HR 5882has notched up 13 co-sponsors, result of hectic lobbying I guess. I just hope all this effort translates into success for us, this is the best time for piecemeal legislations as next year CIR will raise it's ugly head again. No more action till June now. Next session of Senate is on June 2nd and next house session is on June 3rd.

i don't think our cry matters to the American law makers, what matters to them is the cry of AMERICANS. so unless the American people are informed and voice their concern, is only when they will hear especially now that they are going to the polls, they will pass any bill that matters to the electrote.

05/24/2008: July 2007 VB Fiasco I-485 Cases Will Take Nearly Three Years to Clear?

* Most of I-485 applications are currently stuck with the State Department's Visa Bulletin retrogression which are many years behind. However, aside delays which are attributed to the visa number retrogressions, the cases which were filed during the July 2007 Visa Bulletin fiasco period are expected to take nearly three years from the end of the USCIS itsself processing and adjudications in terms of the workloads, according to the CRS report. July 2007 VB fiasco filers, go figure!
* According to the CRS report, the USCIS issues before the Congress are as follows from the perspectives of FY 2009 budget:
o USCIS Issues for Congress. USCIS issues for Congress include the surgein immigration benefit applications that occurred in FY2007 and which resulted in an increase in the agency’s backlog, and the use of the Federal Bureau ofInvestigation’s (FBI’s) National Name Check program to vet immigration benefitapplications.
o Surge in Benefit Applications and Resulting Backlog. According to the testimony of USCIS Director Emilo T. Gonzalez, USCIS experienced an increasein its backlog of naturalization applications in the second half of FY2007.116 From May through July of 2007 USCIS received three and a half times more applications than during the same three months in the previous year.117 Consequently, published accounts indicate that processing time for applications filed during the FY2007 “surge” would be between 16-18 months, as compared to 6-7 months for applications filed in the same period during FY2006.118 For all immigration benefits, the USCIS director testified that the agency received over 1.2 million more applications during the FY2007 surge than in the same period during FY2006, for a total of over 3 million applications. According to media reports, USCIS officials believe that the backlog created by the application surge could take close to three years to clear. Although citizenship campaigns and a contentious national immigration debate have been cited as contributing factors, many observers believe most of the surge in
applications may be attributed to the USCIS fee increase of July 30, 2007. These fee adjustments followed an internal cost review and they increased application fees by a weighted average of 96% for each benefit. The cost of naturalization, formmigration benefit applications that occurred in FY2007 and which resulted in an increase in the agency’s backlog, and the use of the Federal Bureau of Investigation’s (FBI’s) National Name Check program to vet immigration benefit applications.example, increased from $330 to $595. Critics of this new naturalization backlog have mainly raised concerns that applicants would not naturalize in time toparticipate in the 2008 election. USCIS did not include a request for direct appropriations to hire additional temporary personnel to adjudicate the backlog.
o Use of FBI National Name Check Program. An additional potential issue for Congress concerns USCIS’ use of the Federal Bureau of Investigation’s (FBI) National Name Check Program. USCIS officials have estimated that roughly 44% of 320,000 pending name checks for immigration benefit applications have taken more than six months to process, including applications for legal permanent residence (LPR) and naturalization. As a result, the White House has authorized USCIS to grant approximately 47,000 LPR applicants their immigration benefits without requiring completed FBI name checks. Critics of this decision believe it could expose the United States to more security threats. The USCIS ombudsman, however, has argued that USCIS employment of the FBI name check process is of limited value to public safety or national security because in most cases the applicants are living and working in the United States without restriction.

TO HLG,

Please do consider HR 5571 as vehicle for our amendment, it is a bill related to relieving shortage of physicians in medically underserved areas and also may have some immigration benefits to physicians serving in such regions, so atleast it seems related to our legislation in redressing healthcare staff shortage. It is better suited that war appropiations bills, also other legislations such as Agjobs and EB visa recapture amednments are irrelevant to this bill. Hence our amdt may atleast have chance at a debate on the senate or house floor.

I empathize with you. I am also waiting for my PD to be current so my family and I can go back to U.S. as permanent residents. It is depressing to wait and wait without any assurance as to when the visas will be available but I also know that our time will come.

RNs hold about 2.5 million jobs in 2006. Employment of RNs are expected to grow 23% from 2006 to 2016. Many employers in the U.S. are relying on foreign-educated nurses to fill in vacant positions. Source: Occupational Outlook Handbook for Registered Nurses

Well, that is the first thing you should have done, be occupied and productive, rather than waiting for your US application to come into reality. You poor fellows, dont depend your future sa US. Its your choice to invest for the expenses you have for the exams to go to America so be patient. If its yours then it will be given to you in God's time, not in your time. I am somewhat convinced that we should see some positive development for nurses visa before the end of July or even within the next few weeks. I urge everyone not to loose hope. If nothing happens before July, then I am gonna look towards Canada and say good-bye to this broken immigration land. I would squarely blame the democrats for all this mess.

James, you're right. The blame lies with the Congressional Hispanic Caucus for the total lack of immigration amendments passed in Congress. For the record, the Congressional Hispanic Caucus are all democrats - and they are blocking ANY legal immigration advances absent Comprehensive Immigration Reform.

I used to keep hoping, even a few months ago. Unfortunately, the CHC roadblock combined with an election year makes me skeptical anything will pass in 2008. I am grateful to HLG for their efforts, but I think there's just too much ideology and politics in play right now. Only a miracle will get this amendment to pass soon.

On one hand, the Congressional Hispanic Caucus wants Comprehensive Immigration Reform and nothing less. On the other hand, the Republicans in Senate will fight this CIR with all their power. The result is a stalemate and we stand to lose.

My point is, after the November elections a new president and Congress will be installed. BUT what makes anybody think the game in 2009 will be any different from 2007?

We have to keep our hopes up... thank you HLG and CTIHS.

Michael, I agree. CIR would always be tricky no matter when they try to pass it. There is no guaranty it will happen next year. All these democrats are doing now is a great mistake. Skilled immigrants help America to stay ahead of innovations in the world. But now this immigration hostility turns them away to countries like Canada, Australia and India where they are respected and paid well. All of this goes to show that Democratic party is a coalition of invalids who have no vision for this country. They neither want to secure the border nor put country's interest first before their political interest.

i don't think it's a great news because there are many people who
submitted DS 230 up to 4 times , and some received interview letter from consulate, some attended interview and no visa , this all part of a broken immigration system , until you get your visas and clear port of entry here in us you wont be sure whether you are going to be here in us .

Am in the U.S with RN license but can't work yet just accross the street where i live there are hundreds of RN jobs and some vacancies have being open for more than a year.
It is a pity and frustrating for the hospitals and yet they can do nothing about it.

I was listening to USCIS conference call about RN shortages.
Average waiting time for RNs to get visa is 3.5 years. The call was concluded by saying that for Canada this time is 6-8 weeks. The salaries and living standards in Canada are comparable to that of US. I am US educated and licensed RN like Gashe, and I also cannot work here. All hospitals around are giving away sign-up bonuses for RNs and $1,000-2,000 for someone who can refer RN…That is creasy.
I think we are people too and have to respect ourselves. Let us share information about other opportunities in other countries.

I have not done my legal research yet. I am going to do it tomorrow. I am going to start with official government websites. I am going to call Canadian Immigration on Monday. All my friends told me that Canadian Immigration system works like well oiled machine and we actually do not need lawyers or private agencies to get visa, especially if we are US educated RNs. I’ll keep you posted.

Recent development with appropriations bill and the conference call with USCIS Ombudsman were real eye-openers for me. I spent enough on my education and licensing, I have 7 job offers, I have I-140 sitting in the USCIS, and all I can do is to volunteer in surgery waiting room, loose my skills, and run out of money. I have a daughter who is US citizen and I have to support her too…

Long way in my journey, I have always dreamed to be in U.S. but I realize then that opportunities are just here beside me… things I currently enjoy here in my present work in a non-U.S. territory. Why not be contented of what we have now? It was that frustration that thought me that happiness cannot be found in U.S. but in the place where I have leaved my heart.

AHA letter will make no difference. Everybody knows that USA has extreme nursing shortage and US people are paying their toll for this in form of increased number of complications including fatal. Published statistic shows that this understaffing increases complication rate by more than 30%.

Everybody seems to care about it except for US Congress and Senate. They just pretend that something is going on here, they include nursing relief bill into other bills just to show their activity and then remove it from final documents. It was in November 2007, it was just a few weeks ago. Maybe they just want it to be this way. Spanish lobby is not a valid explanation – Spanish immigrants are suffering from nursing shortage too.

Senate Majority Leader Harry Reid already answered this AHA letter by removing nursing amendment from appropriations bill. The amendment had same wording as HR 5924. It does not really metter what senators or congressmen say, what really metters is what they do. And they do nothing about it.

my friend will be leaving for canada this june [not sure which part] she will be working with full salary despite not taking the exam yet. it depends in which part of canada you want to work coz each has their own registration body, but i'm sure fraser will guide you with this.. try aussie coz no need to take exam to be registered..

There is anti-immigrant feeling at US and lawmakers are part of it. Immigration becomes politices of the time and no lawmaker wants to touch it during election time.

However 5924 is a workable bill and AHA's support for this does not mean nothing. It will gain momentum and eventully changes can see at immigration front after presidential election...

# As we all know NVC , in one hand processing files with PD 10 months ahead of cut off dates(P.D. up to dec2006), other hand officially predicting visa retrogression to Unavailablity in coming months
What does two controversial thing mean??

# Client with later P.D (March- dec 2006) whose file is active and some are with completed docs processing at NVC, those applicant may re-made and re-submit police clearance(which automatically expires in 6 months) again and again! Isn't this unnecessary trouble to the applicant???

NVC is telling me that they will

1) Request for a visa number from DOS on June 20th (I missed May batch by 2 days)


2) In the first two weeks of July they will schedule an interview for me for the month of August and will send packet 4 out.

What will happen to my interview in August when my case (EB3 WW) retrogress in August (most certainly).

may I know when was the last time you submited your ds230? how about your Priority date?

If your PD retrogress in August, presumably no interview in August, even if it is scheduled. Though I have seen Atny. Ron says differently.

NVC will ask for docs to update and make all ready. But if PD beomes retrogress , then it is simply of no use!

They have done this to so many international applicants in 2007 August. I do not want to dissapoint u,

But,That is why it is broken system!!!
